The Crunchy Data Developer Program Terms of Use applies to Crunchy Data Software made available by Crunchy Data through the Crunchy Data Developer Program.

Crunchy Data Software is machine readable software packaged, validated and distributed by Crunchy Data as a commercial product. Importantly, this Crunchy Data Developer Program Terms of Use pertains solely to the Crunchy Data Software, and is not intended to limit the rights under the open source license terms applicable to the software source code associated with any particular component included within the Crunchy Data Software.

Under the Crunchy Data Developer Program, Crunchy Data intends to make available and provide access to updates for the latest two major versions of Crunchy Postgres for Kubernetes and PostgreSQL. Older versions of Crunchy Postgres for Kubernetes and PostgreSQL may also remain available under the Program, but will no longer receive updates from Crunchy Data. For additional information regarding the versions of Crunchy Postgres for Kubernetes and PostgreSQL made available under the Crunchy Data Developer Program, please see the Supported Platforms page.

Summary of Terms of Developer Program Use for Crunchy Data Software

Crunchy Data provides this overview of the permitted uses of Crunchy Data Software under the Crunchy Data Developer Program Terms of Use. This overview is provided as a summary of the terms. The full terms of use are described in more detail below.

Permitted Use of Crunchy Data Software Made Available Under Developer Program

The Program permits the free Personal or Internal Use of Crunchy Data Software made available under the Program:

• for individual users working independently on their own behalf or teams of individuals users working on behalf of organizations with less than 50 employees, for both development and production use
• for teams of individuals users working on behalf of organizations with 50 or more employees, for development purposes only.

"Personal or Internal Use of Crunchy Data Software" is intended to include use of Crunchy Data Software on an individual's personal infrastructure or account (including use on public cloud infrastructure), or an organization's infrastructure or account (including use on public cloud infrastructure), for purposes of providing backend database services to the individual or organization’s applications, where the application in question is itself not, or does not include, a database service exposed or provided to third parties.

"Development Purposes” is intended to include the use of the Crunchy Data Software (i) for performing prototyping, (ii) for quality assurance testing and/or (iii) use for demonstration purposes.

“Production Purposes” is intended to include any use of Crunchy Data Software other than for Development Use including, but not limited to, using the Crunchy Data Software (i) in a production environment, (ii) with live data and/or applications and/or (iii) for backup instances.

For the avoidance of confusion, organizations with 50 employees or greater (inclusive of the organization’s affiliated entities) use under the Program is limited to use for development purposes only, including performing prototyping or quality assurance testing and/or for demonstration purposes. Production use of Crunchy Data Software made available under the Program, including use of Crunchy Data Software in a production environment, with live data and/or applications and/or for backup instances, by organizations with 50 employees or greater (inclusive of such organization’s affiliated entities) requires an active Crunchy Data Support Subscription and use without an active Crunchy Data Support Subscription is deemed a violation of the Program.

Acknowledgement of Limitations of Crunchy Data Software Made Available Under the Program

By participating in the Program and accepting these terms, you acknowledge and agree that the Crunchy Developer Software offered to you pursuant to the Program:

• is made available without commercial support; and
• is made available subject to the version release policies and software availability policies of the Program.

It is important that users of Crunchy Data Software made available under the Program familiarize themselves with the version release policies and software availability policies and plan for timely upgrades of the Crunchy Data Software so as to avoid downtime.

Prohibition on Use of Crunchy Data Software in Connection with Consulting or Support Services Delivered to Third Parties.

“Use of Crunchy Data Software in Connection with Consulting or Support Services delivered to Third Parties” is intended to include an individual or organization providing consulting or support services to a third party organization that include the installation, configuration or administration of Crunchy Data Software for the benefit of an end user organization.

Crunchy Data is always interested in exploring new partnerships and is confident we can create an arrangement that will work for you and your end customer.

Prohibition of Resale and Redistribution of Crunchy Data Software

The use of Crunchy Developer Software without an active Crunchy Data Support Subscription or other signed written agreement with Crunchy Data is not permitted to be (1) sold, redistributed, rebranded or otherwise offered as a a service to third parties or (2) used in connection with third party support services.

Crunchy Data is always interested in exploring new resale arrangements and is confident we can create an arrangement that will work for you and your end customer.

Other Terms of Developer Program

No right or license, express or implied, is granted in this Developer Program Terms of Use for the use of any Crunchy Data or third party trade names, service marks or trademarks, including, without limitation, the distribution of the Crunchy Data Developer Software utilizing any Crunchy Data trademarks.

THE CRUNCHY DEVELOPER SOFTWARE IS PROVIDED BY CRUNCHY DATA “AS IS” AND WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON­INFRINGEMENT, AND FITNESS FOR A PARTICULAR PURPOSE. CRUNCHY DATA DOES NOT GUARANTEE OR WARRANT THAT THE USE OF THE CRUNCHY DEVELOPER SOFTWARE WILL BE UNINTERRUPTED, COMPLY WITH REGULATORY REQUIREMENTS, BE ERROR FREE OR THAT CRUNCHY DATA WILL CORRECT ALL SOFTWARE ERRORS.

PLEASE READ THE AGREEMENT CAREFULLY BEFORE USING THE CRUNCHY DEVELOPER SOFTWARE. BY USING CRUNCHY DEVELOPER SOFTWARE, YOU SIGNIFY YOUR ASSENT TO AND ACCEPTANCE OF THE AGREEMENT AND ACKNOWLEDGE YOU HAVE READ AND UNDERSTAND THE TERMS. AN INDIVIDUAL ACTING ON BEHALF OF AN ENTITY REPRESENTS THAT HE OR SHE HAS THE AUTHORITY TO ENTER INTO THE AGREEMENT ON BEHALF OF THAT ENTITY. IF YOU DO NOT ACCEPT THE TERMS OF THE AGREEMENT, THEN YOU MUST NOT USE THE CRUNCHY DEVELOPER SOFTWARE.
